Please read these Terms and Conditions carefully before using the GynaecologyGuide.co.za website (the "Site"). By accessing or using the Site, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Site.

1. Definitions

In these Terms and Conditions, the following words and expressions bear the meanings assigned to them below:

• "Site" means the website located at www.gynaecologyguide.co.za and all associated pages;

• "We", "Us" or "Our" refers to the operator of GynaecologyGuide.co.za;

• "User" or "You" means any person who accesses or uses the Site for any purpose;

• "Practitioner" means any gynaecologist, obstetrician, or women's health specialist whose information appears on the Site;

• "Listing" means the information pertaining to a Practitioner that is published on the Site;

• "Enquiry" means a request submitted by a User via the contact form on the Site expressing an interest in booking a consultation with a Practitioner;

• "Enquiry Form" means the electronic form on the Site through which Users may submit an Enquiry;

• "Services" means the information and enquiry submission services provided through the Site as described herein;

• "HPCSA" means the Health Professions Council of South Africa;

• "POPIA" means the Protection of Personal Information Act 4 of 2013.

2. Nature of the Site

2.1  GynaecologyGuide.co.za is a free, independent women's health information resource. The Site provides users with access to information about gynaecologists and women's health specialists practising in South Africa, to assist users in identifying and contacting practitioners appropriate to their needs.

2.2  The Site operates solely as an information and enquiry facilitation service. We are not a healthcare provider, medical practice, hospital, clinic, or any form of regulated health establishment. Nothing on this Site constitutes, or should be construed as, the provision of healthcare services.

2.3  The information published on the Site is sourced from publicly available records, including but not limited to the HPCSA register and publicly accessible practitioner information. We endeavour to ensure the accuracy of Listings but do not warrant that all information is current, complete, or error-free.

2.4  The Site does not operate a referral service as contemplated under any applicable health professions legislation or the ethical rules of any professional regulatory body. In particular:

• We do not direct or recommend Users to specific Practitioners on the basis of any financial arrangement with those Practitioners;

• The inclusion of a Practitioner in a Listing does not constitute an endorsement, recommendation, or referral;

• Users independently select Practitioners based on the information available on the Site. The decision to contact or consult with any Practitioner rests solely with the User;

• Any fee arrangement between Us and a Practitioner relates exclusively to the administrative service of processing and transmitting Enquiries submitted by Users and does not constitute payment for the referral of patients.

3. Enquiry Form and Booking Facilitation

3.1  The Site provides an Enquiry Form through which Users may submit a request to be contacted by a Practitioner's practice to arrange a consultation. The submission of an Enquiry Form does not constitute a confirmed appointment and does not create any contractual relationship between the User and the Practitioner.

3.2  Upon receipt of a completed Enquiry Form, we will transmit the User's contact details and stated preferences to the relevant Practitioner's practice. The practice will thereafter contact the User directly to confirm, arrange, or decline the appointment at its sole discretion.

3.3  We do not guarantee that:

• A Practitioner will accept or respond to an Enquiry;

• An appointment will be confirmed or fulfilled;

• A Practitioner will be available at any particular time;

• A Practitioner's details, availability, or scope of services as listed on the Site are current at the time of any Enquiry.

3.4  We accept no liability for cancelled, rescheduled, or unfulfilled appointments, or for any loss, expense, or inconvenience arising therefrom.

3.5  The User is solely responsible for verifying, prior to attending any consultation, the Practitioner's fees, medical aid acceptance, location, and any other relevant information.

3.6  Our role in facilitating Enquiries is purely administrative. We are not a party to any consultation, treatment, or contractual arrangement between a User and a Practitioner.

 4. No Medical Advice

4.1  Nothing on this Site constitutes medical advice, a clinical opinion, a diagnosis, or a recommendation for any course of treatment. All information published on the Site is for general informational purposes only.

4.2  Users are strongly advised to consult a qualified and registered healthcare professional regarding any medical condition or concern. Reliance on any information appearing on this Site is solely at the User's own risk.

4.3  If you are experiencing a medical emergency, do not use this Site. Contact your nearest emergency services, hospital, or dial the national emergency number 10177 immediately.

 5. Practitioner Listings

5.1  We publish Listings based on publicly available information. The presence of a Listing on the Site does not constitute an endorsement, accreditation, or recommendation of any Practitioner or their services.

5.2  We endeavour to list only Practitioners who are registered with the HPCSA. However, we do not continuously monitor the registration status of listed Practitioners and cannot guarantee that every listed Practitioner is currently in good standing with the HPCSA or any other regulatory body.

5.3  Users are strongly advised to independently verify a Practitioner's HPCSA registration status by consulting the HPCSA register at www.hpcsa.co.za prior to booking any consultation.

5.4  We do not conduct background checks, clinical assessments, or vetting of any Practitioner's professional conduct, qualifications beyond HPCSA registration, or quality of care. The selection of a Practitioner remains the sole responsibility of the User.

5.5  Practitioners or their practice managers who identify inaccuracies in their Listing may contact us to request corrections. We will endeavour to update Listings within a reasonable time upon receipt of verified information.

 6. Information Regarding Termination of Pregnancy

6.1  Where indicated on a Practitioner's Listing, the Site may reflect whether that Practitioner offers termination of pregnancy services. This information is provided for the sole purpose of assisting Users in identifying practitioners who offer such services, in accordance with the Choice on Termination of Pregnancy Act 92 of 1996.

6.2  The inclusion or exclusion of this information in a Listing does not constitute a recommendation or referral. We do not provide advice on the suitability of any procedure for any individual User.

6.3  This information is subject to change. Users must confirm directly with the Practitioner's practice whether this service is currently available prior to booking.

 7. User Conduct

7.1  By using the Site, you agree that you will:

• Use the Site only for lawful purposes and in accordance with these Terms and Conditions;

• Provide accurate and truthful information when completing the Enquiry Form;

• Not submit Enquiries with no genuine intention of attending a consultation;

• Not use the Site in any manner that could damage, disable, overburden, or impair the Site or its infrastructure;

• Not attempt to gain unauthorised access to any part of the Site, its systems, or any associated networks;

• Not use any automated means, including scraping tools, bots, or crawlers, to extract, copy, or index any content from the Site for any commercial or non-personal purpose;

• Not reproduce, redistribute, or commercially exploit any content from the Site without our prior written consent.

7.2  We reserve the right to restrict or terminate access to the Site for any User who violates these Terms and Conditions or who uses the Site in a manner we deem inappropriate or harmful.

 8. Intellectual Property

8.1  All content on the Site, including but not limited to the Site's design, layout, text, graphics, and underlying code, is the intellectual property of GynaecologyGuide.co.za or its licensors and is protected under applicable South African intellectual property law.

8.2  Users are granted a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes only. No content may be copied, reproduced, republished, transmitted, or exploited for any commercial purpose without our prior written consent.

8.3  Practitioner names, addresses, contact numbers, and HPCSA registration details constitute factual, publicly available information and are not claimed as proprietary by Us. However, the selection, arrangement, and presentation of such information on the Site constitutes a protectable compilation and may not be reproduced in a systematic or commercial manner without our consent.

 9. Disclaimer of Warranties

9.1  The Site and all content and services provided through it are offered on an "as is" and "as available" basis without any warranty of any kind, whether express or implied.

9.2  We expressly disclaim all warranties, including but not limited to:

• The accuracy, completeness, currency, or reliability of any Listing or information on the Site;

• The fitness of any listed Practitioner for any particular User's needs;

• Uninterrupted or error-free operation of the Site;

• The absence of viruses, malware, or other harmful components on the Site.

 10. Limitation of Liability

10.1  To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages of any kind arising from or in connection with:

• The use of, or inability to use, the Site or its Services;

• Reliance on any information published on the Site;

• Any act or omission of a Practitioner listed on the Site;

• The outcome of any consultation, treatment, or procedure arranged through or following use of the Site;

•  Any failure or delay by a Practitioner to respond to or fulfil an Enquiry;

• Errors, inaccuracies, or omissions in any Listing.

 11. Indemnification

You agree to indemnify and hold harmless GynaecologyGuide.co.za, its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your breach of these Terms and Conditions; or (c) any information you submit through the Site, including false or misleading Enquiry Form submissions.

 12. Privacy and Personal Information

12.1  The collection, use, storage, and processing of personal information submitted through the Site, including information provided via the Enquiry Form, is governed by our Privacy Policy, which forms part of these Terms and Conditions and is incorporated herein by reference.

12.2  By submitting an Enquiry Form, you consent to your personal information being transmitted to the relevant Practitioner's practice for the sole purpose of facilitating the requested appointment enquiry.

12.3  We process all personal information in accordance with POPIA. Please refer to our Privacy Policy for full details of how we handle your information and your rights as a data subject.

 13. Third Party Links

The Site may contain links to external websites for the convenience of Users. We do not control, endorse, or accept responsibility for the content, privacy practices, or accuracy of any third party website. Access to any linked site is at the User's own risk.

 14. Amendments to These Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time. Amended terms will be published on the Site with an updated "Last Updated" date. Your continued use of the Site following the publication of any amendment constitutes your acceptance of the amended Terms and Conditions. It is your responsibility to review these Terms and Conditions periodically.

 15. Governing Law and Dispute Resolution

15.1  These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.

15.2  Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

 16. General

16.1  If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

16.2  Our failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or any other provision.

16.3  These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and us with respect to your use of the Site and supersede all prior agreements, representations, and understandings.

16.4  We may assign our rights and obligations under these Terms and Conditions at any time. You may not assign your rights or obligations without our prior written consent.

16.5  You must be 18 years of age or older to use this Site. If you are under 18, you may only use the Site with the consent and supervision of a parent or legal guardian.
